Terms of Service & Consultation Agreement

Welcome to Brainy Nutrition. These Terms of Service ("Terms") govern the 1-on-1 nutrition consultation services provided by Bethany Jane Durrant trading as Brainy Nutrition ("we", "us", or "our"). By booking a consultation or purchasing a service, you ("the Client") agree to be bound by these Terms.

  • Services & Professional Scope of Practice

    • Scope of Care: Bethany Jane Durrant is a Registered Associate Nutritionist (ANutr) registered with the Association for Nutrition (AfN). Practitioners operate in accordance with the AfN Code of Ethics and those working in a freelance capacity with clients must hold full Professional Indemnity Insurance within the UK. Bethany provides evidence-based nutritional guidance and lifestyle coaching tailored to support brain health and overall well-being.

    • Not Medical Advice: Services provided do not constitute medical diagnosis, medical treatment, or clinical dietetics. Nutritional consultations do not replace the care of a General Practitioner (GP) or qualified medical specialist.

    • Medical Supervision: Clients with existing medical conditions, chronic illnesses, or prescribed medications must inform their GP before making significant changes to their diet or supplement regimen.

  • Booking, Payment, & Pricing

    • Payment Terms: All consultations and packages must be paid in full prior to the scheduled appointment, unless agreed otherwise in writing.

    • Pricing & Fees: Consultation fees are clearly stated at the time of booking. We reserve the right to modify pricing for future bookings, but fee changes will not affect bookings already confirmed.

  • Cancellations, Rescheduling, & Refunds

    • 24-Hour Cancellation Policy: If you need to cancel or reschedule your appointment, please provide at least 24 hours' notice. Cancellations made with less than 24 hours' notice may incur the full consultation fee.

    • Late Arrivals: If you arrive late to a session, the consultation will still end at the scheduled time, and the full session fee will apply.

    • Refunds: Payments for completed consultation sessions are non-refundable. For consultation packages, unredeemed sessions may be refunded upon request within 30 days of purchase, minus any completed sessions charged at the single-session rate.

  • Client Responsibility & Informed Consent

    • Accurate Information: The Client is responsible for providing complete and accurate information regarding their health history, lifestyle, dietary intake, and medical history. We are not liable for any consequences arising from inaccurate or withheld information.

    • Implementation: Nutritional recommendations are advisory. The Client retains full personal responsibility for implementing dietary changes and lifestyle adjustments.

  • Confidentiality & Data Protection

    • Privacy Compliance: We handle all client data in strict accordance with UK GDPR, the Data Protection Act 2018, and our Privacy Policy.

    • Confidentiality: Information disclosed during consultations will remain strictly confidential, except where disclosure is required by law or if there is a serious, immediate safety risk to the client or others.

    • ICO Registration: Brainy Nutrition is required to register with the Information Commissioner’s Office (ICO) before taking on their first client.

  • Liability & Disclaimers

    • To the fullest extent permitted by UK law, Brainy Nutrition is not liable for any direct, indirect, or consequential loss arising from the use or implementation of our advice, website content, or consultation services.

    • Professional liability coverage is maintained in accordance with Association for Nutrition (AfN) standards. This is required when working in a freelance capacity with clients.

  • Governing Law

    These Terms are governed by and construed in accordance with the laws of England and Wales, and any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
